From how I understand it, the skill will only decrease when you have no points available.  So once you use up all of your points (which is pretty hard to do since the weapon skills go up so painfully slow), then it will start draining your shruiken skill if you still have room to raise whatever skill you are using.

Agreed.  The haste is best to use in groups.  I switch to damage stance when we are in trouble and need alot of dps quickly.  However, whenever I use it, I steal aggro very easily and some people get upset at this.

Well, the stance just adds to your chance to dodge.  Without the stance I'm at around 22%, I think.

What con mobs are you fighting that you are failing 80% of the time?  When I pull in my groups, FD is extremely reliable.  This is only just for mobs up to red cons tho.  Once we get into purple cons, they see through it almost every time.  Perhaps you are just going for mobs out of your skill level, and if that is the case, then yes I would say it is working as intended.
